Terms of Service

1. Acceptance

Cityfit is operated by S & Q DEVELOPMENT LIMITED (NZ company number 8180636, NZBN 9429049255676), 120 Taylor Street, Blockhouse Bay, Auckland 0600, New Zealand ("Cityfit", "we", "us"). By creating an account, subscribing or otherwise using the service, you agree to these Terms of Service. If you do not agree, do not use Cityfit.

2. What Cityfit is (and is not)

Cityfit is an informational AI tool that helps you explore which cities may suit your lifestyle preferences. All reports, radar charts, cost-of-living figures and 90-day checklists are AI-generated estimates for general informational purposes only.

Cityfit is not, and does not provide: real estate or property investment advice; immigration, visa or legal advice; relocation, moving or destination-services brokerage; or financial or tax planning. We are not a licensed advisor, agent, broker or intermediary of any kind. See our AI Disclaimer for full detail. You are solely responsible for any decision you make.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use Cityfit. By using the service you represent that you meet this requirement.

4. Accounts

You are responsible for keeping your account credentials secure and for all activity under your account. Provide accurate information and keep it current. Notify us at support@developmentsnz.com of any unauthorised use.

5. Subscriptions & billing

Paid plans are sold as recurring subscriptions that renew automatically until cancelled. Full pricing, billing cycles, auto-renewal and cancellation details are set out in our Subscription Terms, and our refund position is in the Refund Policy. Payments are processed by our payment provider (such as Stripe or PayPal) or, for some purchases, by a merchant of record (such as Creem) that acts as the seller of record; we do not store your card details.

6. Acceptable use

You agree to use Cityfit lawfully and in line with our Acceptable Use Policy. We may suspend or terminate accounts that breach it.

7. Intellectual property

Cityfit and its software, design, branding and content are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the service for your personal, non-commercial use. Reports generated for you are for your own use and may not be resold or redistributed.

8. Disclaimers & "as is"

Cityfit is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service or any AI-generated output is accurate, complete, current or fit for any particular purpose. Nothing here excludes guarantees that cannot lawfully be excluded, including under the New Zealand Consumer Guarantees Act.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or any loss arising from decisions you make based on Cityfit output. Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold us harmless from claims, losses and expenses arising from your misuse of the service or breach of these terms.

11. Changes to the service or terms

We may modify, suspend or discontinue any part of the service, and may update these terms from time to time. If changes are material we will give reasonable notice. Continued use after changes take effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of New Zealand. You and we submit to the exclusive jurisdiction of the New Zealand courts for any dispute arising out of or relating to the service, except where mandatory local consumer law gives you a different forum.
